Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SocialTank (the “Service”), a social media management and AI platform operated by Efficiency and quality company for trading LLC, a limited liability company registered in Muscat, Sultanate of Oman (“EQCT”, “we”, “our”, or “us”). By creating an account, connecting a social media account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf, and “you” refers to that organisation. These Terms should be read together with our Privacy Policy, which explains how we collect, use, and protect personal information.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service, which is intended for business use. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. Organisation administrators are responsible for managing the access and permissions of their team members.

2. The Service

SocialTank lets businesses connect their social and messaging channels in one dashboard to:

• Answer incoming messages and reply to comments, automatically or with human review
• Compose content once and publish or schedule it to the accounts you connect
• Build private AI knowledge bases that answer from your own content
• Run AI grading and assessment workflows, where enabled
• Manage conversations, teams, analytics, and billing

Features, supported platforms, and limits may change over time. We may add, modify, or discontinue parts of the Service at our discretion, and we may impose or adjust usage limits associated with your plan.

3. Connecting Third-Party Platforms

The Service integrates with third-party platforms, including Meta (Facebook, Instagram, and the WhatsApp Business Platform) and TikTok, with further platforms added over time. When you connect an account, you authorise us, through that platform's official APIs and only within the permissions (scopes) you grant, to act on your behalf — for example, to receive messages and comments, or to publish or schedule content to your own connected account.

• You may only connect accounts that you own or are authorised to manage, and you must comply with each platform's own terms and policies, including the TikTok Terms of Service and, where music is used, TikTok's Music Usage Confirmation.
• We access, use, and store third-party platform data solely to provide the Service to you. We do not sell it, and we do not use it for advertising or to train foundation models.
• You can disconnect any integration at any time from the Integrations area, and you may revoke access from within the third-party platform. Disconnecting stops further access.

We are not responsible for the availability, changes, or actions of third-party platforms, including suspension or removal of your accounts by those platforms.

4. Your Content and Responsibilities

You retain ownership of the content you create, upload, or publish through the Service, including knowledge base material, media, posts, and messages (“Your Content”). You grant us a limited, non-exclusive licence to host, process, transmit, and display Your Content solely to deliver the Service — for example, to publish your posts, generate AI responses, and maintain conversation records. You are solely responsible for Your Content and represent that it does not infringe any third-party rights and does not violate any law or any connected platform's policies. You must not use the Service to publish unlawful, deceptive, harmful, or infringing content, or to engage in spam or automated abuse of any platform.

5. Acceptable Use

You agree not to misuse the Service, including by attempting to access it in an unauthorised way, interfering with its operation, reverse-engineering it, or using it to violate the rights of others or the terms of any connected platform. You are responsible for the messages, comments, and posts you send, publish, or schedule, and for the outcomes of any automated replies you enable. We may suspend or terminate access that we reasonably believe violates these Terms or any platform policy.

6. AI-Generated Output

The Service uses artificial intelligence to generate replies, summaries, grades, and other output. AI output can be inaccurate, incomplete, or unsuitable, and it is provided without any warranty of correctness. You are responsible for reviewing AI-generated content before relying on it or allowing it to be sent, published, or used for decisions — including where you enable automatic replies. AI grading and assessment features are aids and do not replace human judgement.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Efficiency and quality company for trading LLC and its licensors and is protected by intellectual property laws. These Terms grant you no rights in our intellectual property other than the limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

8. Fees, Billing, and Subscriptions

Paid plans are billed in advance on a recurring basis through our payment provider. By subscribing, you authorise us and our payment provider to charge the applicable fees and any taxes for each billing cycle until you cancel. Fees are non-refundable except where required by law or expressly stated. We may change pricing or plan limits with reasonable notice; continued use after a change takes effect constitutes acceptance of the updated fees. If a payment fails or a subscription lapses, we may suspend or limit access to paid features.

9. Privacy and Data Protection

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. You are responsible for complying with applicable data protection laws in respect of the end users whose data you process through the Service, including providing any required notices and obtaining any required consents.

10. Service Availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or secure. We may perform maintenance, updates, or changes that temporarily affect availability, and the Service depends on third-party platforms and providers whose availability is outside our control.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, that AI output will be accurate, or that publishing to any third-party platform will always succeed, as that depends on those platforms and their APIs.

12. Limitation of Liability

To the maximum extent permitted by law, Efficiency and quality company for trading LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Efficiency and quality company for trading LLC and its staff from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party rights, including a connected platform's policies.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or any connected platform's policies, or as necessary to comply with law. Upon termination, your right to use the Service ceases and connected integrations are disconnected. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

15. Governing Law

These Terms are governed by the laws of the Sultanate of Oman, and the courts of Muscat, Sultanate of Oman have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, unless a mandatory law in your place of residence requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
